What are Seller’s Remedies if Buyer Refuses to Deliver the Due Diligence Fee?

VERY IMPORTANT READ!

If the buyer does NOT deliver the DD Money after the contract has been signed into effect, the seller can serve WRITTEN NOTICE to deliver the dd funds. IF THE BUYER does NOT deliver the funds, the seller has a right to:

  1. Terminate the contract
  2. Collect the dd money
  3. AND THE EARNEST MONEY (AND ATTORNEY FEES!)

Also, the buyer CANNOT terminate the contract UNTIL THEY HAVE DELIVERED THE DD MONEY! If the buyer does deliver the dd money as required and terminates the contract (which is within their dd rights) then the seller does NOT have rights to the earnest money.
